Nursing home liability and elder abuse

While many nursing homes provide excellent care for our most vulnerable Georgians, many take advantage of their helpless residents. The federal and state regulations that govern nursing homes are complex, but we can help.  

Just as in other legal agreements, a nursing home accepts a certain level of responsibility when accepting new residents, a “duty of care.” The nursing home has a responsibility to provide its residents with a level of reasonable care to protect residents and provide them with a safe environment - this is what they get paid to do. So, when a nursing home fails to provide this level of reasonable care and one of its residents is hurt or dies,it should be held accountable.

Whistleblower & medicare and medicaid fraud

Since 1986, whistleblowers have helped recover more than $27 billion in taxpayer money that was then repaid to the government. That is why we pursue whistleblower cases.

If you work for a company that submits fraudulent bills to government programs like Medicare or Medicaid, there is a way to come forward to expose the fraud and protect yourself. Under federal law, an individual citizen is empowered to bring suit on behalf of the United States government for actions that the citizen believes are fraudulent. These types of cases are known as Qui Tam or False Claims Act Cases (or if tax related – IRS Whistleblower Cases). If the government is able to recover money, the individual who filed the case (known as a “relator”) may be entitled to 15-30% of the government’s recovery. More importantly, there are provisions in these laws that protect relators from job discrimination or harassment for reporting the fraud.

False Claims Act cases can run the gamut and include everything from double billing to billing for expensive equipment while providing a cheaper alternative. Yet they all share one thing in common, someone is ripping our government off. The same is true of IRS Whistleblower cases.

trucking wrecks

Every 16 minutes in the United States, a person is injured or killed in an auto wreck involving a large commercial truck. Due to the sheer size and weight of tractor-trailer trucks, most collisions with smaller vehicles result in serious injuries or fatalities. According to the National Highway Safety Administration, one out of every nine traffic fatalities involves a large truck.

Unfortunately, these accidents are not really “accidents” and are usually caused by someone’s negligence. There are several critical factors that can result in a devastating tractor-trailer wreck: unsafe operation by the truck driver, poor truck maintenance, truck driver inexperience, distraction, mechanical failure, and truck driver fatigue.
